OMiK stands between the buyer and the seller on every deal that begins here. These terms say what that means in practice — what may be advertised, what an enquiry does, what the paid listing buys, and when a commission is owed.
1. Who we are, and what these terms cover
These terms govern the use of the marketplace published at omik.ae by OMiK HOLDiNG ("OMiK", "we", "us"). They apply to everyone who uses it: a visitor who only browses, a member who registers, and an advertiser who publishes a listing.
Using the marketplace means accepting these terms. If you do not accept them, do not use it.
2. OMiK's role: a mediator, not a shop window
OMiK mediates every deal that begins on this marketplace. We are not the seller of what is advertised and, unless we have agreed otherwise in writing, we are not a party to the contract that the buyer and the seller conclude between them.
Every enquiry on every listing reaches OMiK. An advertiser's telephone number and e-mail address are not published on the listing page, and enquirers' names are not shown to the advertiser. This is how the marketplace works, on the free listing and on the paid one alike, and it is the reason we are able to tell an advertiser how many people asked about their listing.
3. Your account
Registration requires a valid e-mail address, which must be confirmed before the account can be used, and a mobile number. The details you give must be true and kept up to date; an account opened on false details may be closed.
Accounts registered as a business — a brokerage, an agency, a developer, a supplier or a broker — are reviewed by us before they may publish. We may ask for a trade licence, a regulatory registration number or proof of identity, and we may refuse a registration without giving reasons. Browsing and enquiring are not affected while a review is under way.
You are responsible for what is done through your account and for keeping your password to yourself. Tell us at once if you believe someone else has reached it.
4. Listings
You may publish a listing only for something you own or that you have the owner's authority to offer, and what you say about it must be accurate — the price, the area, the quantity, the specification, the photographs and the availability.
A listing must not carry contact details, and must not offer anything whose sale is restricted or forbidden by the law of the United Arab Emirates. Duplicate listings for the same property or the same lot may be removed.
Every listing is reviewed before it appears. We may publish it, ask you to correct it, refuse it, or take it down after publication if it turns out to be inaccurate or no longer available. An advertiser may withdraw their own listing at any time.
You keep ownership of the photographs and text you upload, and you give OMiK permission to display them on the marketplace and to use them in promoting the listing for as long as it is published.
5. The featured listing
A listing may be published free of charge, or featured for 750 AED, chosen at the moment of writing it. Value added tax is added where it applies.
A featured listing is promoted on the marketplace, and our team works it: we look for a buyer for it rather than only answering the enquiries it receives. What the fee does not buy is a sale — no result is promised, and the fee is not a commission.
The fee is payable before the listing is promoted and is not refundable once it has been, except where we did not deliver what was paid for.
6. Commission
OMiK's commission is earned when a deal that began on this marketplace is concluded. Its rate is agreed in writing with the party who owes it before the deal closes; it is separate from any listing fee, and a listing fee is not set off against it.
If OMiK introduces two parties and they then conclude the deal directly, or through somebody else, or after the listing has been taken down, the commission is still owed. This holds for twelve months from the introduction. Concealing a concluded deal in order to avoid the commission is a breach of these terms.
A broker registered with OMiK is paid their share after the commission has actually been collected from the client. Money we have not received is not money we can pay out.
7. What the advertiser sees
An advertiser sees figures and stages for their own listing: how many opened it, how many enquired, how many saved it, and where it has reached. They do not see the name, the telephone number or the e-mail address of anyone who enquired, at any stage.
8. What we do not promise
Listings are written by their advertisers. We review them, but a review is not a survey, a valuation, a title search or a laboratory test. Satisfy yourself about what you are buying, and about the person you are buying it from, before you commit money to it.
We work to keep the marketplace available, and we do not promise that it will never be interrupted.
To the extent the law allows, OMiK's liability arising out of the use of this marketplace is limited to the amount of the fees you paid us in the twelve months before the claim arose, and we are not liable for profit you expected and did not make.
9. Suspension and closure
We may suspend or close an account that breaches these terms, that publishes what is untrue, or that is used to reach members for a purpose other than the one the marketplace is for. You may close your account at any time; closing it does not cancel a commission already earned or an amount already due.
10. Changes to these terms
We may amend these terms. The date at the top says when the version you are reading was published, and we tell registered members of a material change by e-mail. Continuing to use the marketplace after a change means accepting it.
11. Governing law
These terms are governed by the laws of the United Arab Emirates, and the courts of Dubai have jurisdiction over any dispute arising out of them.
If a clause of these terms is found unenforceable, the rest of them remain in force.
